The Parties mutually agree to submit all disputes, legal suits, actions or claims arising out of or in connection with this Agreement to the exclusive jurisdiction and venue of the 11th Circuit Court of Florida. This Agreement, regardless of where actually accepted or delivered, is deemed to have been accepted and delivered by the parties in the State of Florida.In order to assure the accuracy of the data or information, the Clerk’s office should be consulted regarding the Official Court Record. A gap may exist between the time paper documents are filed in the Clerk’s office and when they are indexed and imaged for electronic viewing. Service through the Clerk’s electronic access is not the official record of the Clerk.Nothing in this Agreement may be construed as waiving the sovereign immunity of the Clerk or the Clerk’s employees and agents or of the Registered User’s sovereign immunity, if applicable, or modifying the recovery limits against the Clerk or Registered User as set forth in section 768.28(5), Florida Statutes.Registered User releases Clerk and Clerk’s employees and agents from any liability and any damages resulting from or related to (a) interrupted service of any kind (b) Registered User’s equipment (c) use of, or viewing of, electronic court records*.To provide computer hardware and software and/or making modifications to existing equipment for access to the site.To not use or permit others to use the information obtained from this site for commercial or resale purposes and that all activity on this site will be tracked and monitored by Clerk to enforce this provision.To understand that paper or electronic documents may not be immediately available online after they are filed with Clerk.To provide updated contact information or, for parties, updated case information by submitting a new Request Form, which, when submitted, is incorporated by reference in this agreement.To immediately notify Clerk if Registered User discovers that the assigned password is known by another person, whether used or not, so the existing login ID may be deactivated and replacement login information issued.To prohibit any person or entity other than Registered User from accessing the site.To ensure that only Registered User has knowledge of the assigned login ID and password and unique PIN or Party ID number, if applicable. Clerk will maintain and modify the site as required by AOSC15-18.Use the “Contact Us” form for help with the site. Clerk will notify Registered User of a unique login ID and password, with directions on how to change the password and a unique PIN or Party ID number, if applicable.Clerk will endeavor to provide uninterrupted access to the site, which may be interrupted for maintenance, network or power failures, or security issues.This Agreement is for viewing electronic court records* as authorized pursuant to Florida Supreme Court Administrative Order 2015-18 (AOSC15-18).You may use the Advanced Search in the Official Records application without having to submit the above mentioned form. The forms are being processed in the order in which they are received, and it may take up to business days to receive the confirmation emails, dependent on the number of forms received.ĪOSC 15-18 does not restrict viewing of County Recorder Official Records. If you have submitted the Registered Access Request form, but have not yet received your confirmation email, you may use the Standard Search. You will receive an email once your form has been processed, confirming that your access to the Advanced Searches has been enabled. Follow the instructions to avoid delays in processing. You will need to submit the Registered Access Request form. This Administrative Order sets standards for viewing of electronic court records whereby use of Advanced Searches requires the submission of a notarized Registered Access Request form to ensure identity. The Miami-Dade Clerk of Courts greatly expanded Internet Public Viewing on June 9th, 2015 in accordance with the provisions of Florida Supreme Court Administrative Order SCġ6-14 (AOSC 16-14).
